These Terms & Conditions (“Terms”) govern your access to and use of https://apesproduction.com/ (the “Website”) and any services provided by Apes Production (“we”, “us” or “our”).

By accessing the Website, requesting a quotation, approving a proposal, or making any payment, you agree to be bound by these Terms.

1. Services

Apes Production provides digital services, including but not limited to:

  • Website design and development

  • Website redesign or revamp

  • Landing page creation

  • E-commerce setup

  • AI chatbot integration

  • Website maintenance and support (one-time or recurring)

  • Digital consulting

The exact scope of work will be confirmed in writing via a proposal, quotation, invoice, email, or message before any work begins.

2. Pricing & Quotations

All prices displayed on the Website or any sub-page (including regional pages) are for reference only and may be updated or changed at any time without prior notice.

Final pricing will always be confirmed in a written quotation or invoice before work begins.

Special pricing may be offered to selected clients, partner platforms or listing directory members (including HBDIR members), or during promotional periods.

A project is only considered confirmed once written approval is provided and/or payment is received.

We reserve the right to accept or decline any project request at our discretion.

3. Payment Terms

Unless otherwise agreed in writing:

  • Payment (full or partial) is required before work begins

  • Larger projects may require milestone-based payments

  • Late or non-payment may result in:

    • Suspension of services

    • Removal of completed work

    • Delay in delivery

    • Termination of the project

Any costs related to third-party providers (e.g. hosting, platforms, plugins, software subscriptions, domain registration, payment gateways, automation tools) are not included in our service fees unless explicitly stated.

4. Third-Party Services & Providers

Some Services may require the use of third-party tools, platforms or service providers, including but not limited to:

  • Hosting providers

  • Domain registrars

  • Email or server services

  • AI platforms (e.g. Voiceflow)

  • Automation tools

  • Premium plugins or themes

  • Analytics tools

  • Payment gateways

Unless otherwise stated in writing:

  • All third-party subscription or usage fees are the responsibility of the client

  • These costs are separate from Apes Production’s service fees

  • Payment may be made:

    • Directly by the client to the provider, or

    • Through Apes Production and reimbursed by the client

Apes Production is not the owner, operator, or developer of any third-party platforms and therefore:

  • Makes no guarantees on their availability, performance, uptime or security

  • Is not responsible for price changes, outages, policy changes or termination of service

  • Is not liable for any disruptions, loss of data or functionality caused by such providers

If a third-party service expires, is suspended, or is not paid for, this may affect the website or its features (including hosting, chatbot, forms, booking systems, etc.), and Apes Production shall not be held responsible.

5. Free Demo / Trial

Where a free demo, preview or sample is offered:

  • It is strictly for evaluation purposes only

  • Ownership remains with Apes Production unless full payment is made

  • If the client chooses not to proceed:

    • No files or source materials will be released

    • Apes Production may reuse or modify the design or layout

6. Revisions & Scope Changes

Revisions are limited to the scope stated in the agreed package or proposal.

Any additional work outside the original scope may require:

  • Additional fees

  • A revised timeline

  • A new written agreement

Once a design or function is approved, further changes may be treated as a separate project.

7. Client Responsibilities

The client agrees to:

  • Provide accurate, legal and appropriate content

  • Ensure full rights and permission over all provided materials (text, images, videos, logos)

  • Provide feedback and approvals in a timely manner

  • Maintain valid subscriptions for required third-party services

  • Secure a domain and hosting (if not included)

The client agrees to indemnify Apes Production against any claims arising from content or materials they provide.

8. Intellectual Property

Upon full payment:

  • The client receives the right to use the final, approved work for business purposes

  • Apes Production retains ownership of:

    • Frameworks, systems and methods

    • Templates and internal code structures

    • Draft concepts and unused materials

Apes Production reserves the right to display completed projects in its portfolio, website or marketing channels unless otherwise agreed in writing.

9. No Guarantees

Apes Production does not guarantee:

  • Search engine rankings

  • Website traffic

  • Leads or sales

  • Revenue growth

  • Third-party performance

All services are provided on a best-effort basis only.

10. Limitation of Liability

To the fullest extent permitted by law, Apes Production shall not be liable for:

  • Loss of profits or business

  • Loss of data or information

  • Security breaches beyond our control

  • Third-party platform failures

  • Indirect or consequential damages

Any liability, if determined by a court, shall not exceed the total amount paid by the client to Apes Production for the particular service in dispute.

11. Termination

Either party may terminate the agreement by written notice.

Upon termination:

  • All completed and in-progress work must be paid for

  • No refunds are guaranteed after work begins

  • Apes Production may retain and reuse non-final materials

12. Recurring Services 

For recurring services:

  • Billing may occur monthly, quarterly or annually

  • Clients must give at least 14 days’ notice before the next billing cycle to cancel

  • No partial refunds will be provided for unused time once a billing cycle has started

13. Governing Law

These Terms shall be governed by and interpreted under the laws of Singapore.

All disputes shall be subject to the exclusive jurisdiction of the courts of Singapore.
